Being Arrested for DUI in GA Triggers an Immediate License Suspension Action

When you were arrested for DUI in Georgia, the officer likely took your plastic driver's license. In its place you got a paper form called a DDS 1205. That form gives you short-term driving rights. It also warns that your license – or your right to drive in Georgia, if another state issued your license – will be suspended.

The paper permit is good for 45 days. But you must act within 30 days. The license suspension GA form sets up an administrative license case. That case is separate from the criminal case. You will also have a court date for the criminal charge. The form covers refusal of a blood test and has a slot for a breath test result. Field sobriety tests are optional, though the officer may not have said so.

Many people mix up the drunk driving ticket they get at the scene with the DDS 1205 form. They are two different papers. The uniform traffic citation – often called a drunk driving ticket – is the charging paper the officer writes for the criminal case. It names the count, which is usually driving under the influence.
